A two-vehicle crash that occurred Friday afternoon has left at least three people injured.  According to the Denham Springs Police Department, the accident occurred on 4H Club road near Springwood Boulevard.  Officials say three people sustained injuries as a result of the crash, one of which was transported in serious condition.

Guest Passenger

Louisiana does not have a guest passenger statute.  A guest passenger must rely on the rules of ordinary negligence.  A passenger who gets hurt in a car accident usually has an easier case than a driver or any other type of personal injury plaintiff.  The reason behind this is because the passenger does not have to prove liability since he was not a driver.

Two Vehicle Crash

In a two-vehicle crash, if the driver who was driving the vehicle that the passenger was in is determined to be at fault, the passenger has the legal right to file the claim against the driver’s insurance policy.  If the other driver is found at fault, the passenger can pursue a claim against the other driver’s insurance coverage.  Even if the other driver was less at fault than the driver with whom the passenger was traveling, he or she still has the right to collect compensation from the other driver because that driver shared in liability.

Uninsured Motorist

If the at-fault driver does not carry insurance, you may be covered under the insurance policy of your driver’s uninsured motorist coverage.  According to the Louisiana Department of Insurance, if the owner of the car that you were in at the time of collision has medical payments coverage, then this coverage type is designed to cover your injuries as a passenger, regardless of who was at fault.
